1. Agreement to these Terms

These Terms of Use govern your use of MuscleDial ("the app"), developed by German Amaya ("we", "us"). By downloading or using the app you accept these Terms. If you do not accept them, do not use the app.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use MuscleDial. If you are under the age of majority, you may use it only with the involvement of a parent or guardian.

3. Permission to use MuscleDial

We grant you a personal, non-exclusive, non-transferable, revocable license to use MuscleDial on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse engineer, decompile, rent, resell, or redistribute the app, except where such restriction is prohibited by law.

4. Your training data

The training days you record are yours. They stay on your devices and in your own iCloud storage; we neither receive nor claim any rights over them. You are responsible for keeping your devices and Apple Account secure, and for maintaining your own copies of anything you consider important.

6. Apple services and iCloud

MuscleDial relies on Apple services — including iCloud, the App Store, and Apple's device-to-device connectivity — which are provided by Apple under Apple's own terms. Availability, reliability, and synchronization timing of those services are outside our control, and we are not responsible for their interruption, delay, or failure.

7. Free period and purchase

MuscleDial is free to download and fully usable for seven days from first launch. After that period, continued use requires a one-time purchase made through the App Store.

• The purchase is a single payment. It is not a subscription and does not renew.
• The price shown in the app is the price charged by the App Store for your region, including any applicable taxes.
• The purchase is tied to your Apple Account and applies to devices signed in to that account. Use Restore purchase in Settings on a new device.
• All payments are processed by Apple. Refunds are handled by Apple under its own policies; we cannot issue them.
• The free period is measured on your device and through your iCloud account. Reinstalling the app does not restart it.

8. Ownership and intellectual property

MuscleDial, including its name, artwork, anatomical illustrations, interface, and underlying software, is owned by German Amaya and protected by intellectual property law. These Terms grant you a license to use the app; they transfer no ownership.

9. Updates, availability, and changes

We may update MuscleDial to fix problems, improve it, or maintain compatibility with new operating systems. Features may change or be removed. We may also discontinue the app; if we do, it will continue to function on devices where it is already installed for as long as the operating system supports it, but we cannot guarantee that indefinitely.

10. Disclaimers

To the maximum extent permitted by law, MuscleDial is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data will never be lost.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for loss of data, loss of profits, or personal injury arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for MuscleDial.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

12. Apple-specific terms

You acknowledge that these Terms are between you and us, not with Apple, and that Apple is not responsible for MuscleDial or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.

Apple is not responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app infringes intellectual property rights.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with any applicable third-party terms when using the app.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

13. Termination

These Terms apply while you use MuscleDial. You may end them at any time by deleting the app. We may suspend or end your license if you breach these Terms. Sections that by their nature should survive — ownership, disclaimers, limitation of liability — continue to apply after termination.

14. Governing law and consumer rights

These Terms are governed by the laws of Peru, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws in your country of residence, and you may bring proceedings in the courts of that country.

15. Changes to these Terms

We may update these Terms. The current version is always available on this page with its effective date. Continuing to use MuscleDial after a change means you accept the updated Terms.

16. Contact
